Terms of Service

1. Acceptance of Terms

By creating an account, starting the interactive demo, or otherwise using Big E-Z Books+ (the “Service”), you agree to these Terms of Service and our Privacy Policy. If you are using the Service for a business, you confirm you have authority to accept these Terms on its behalf. If you do not agree, do not use the Service.

2. The Service

Big E-Z Books+ is online bookkeeping software provided by Big E-Z Bookkeeping Co. (“we”, “us”). It helps you record and categorize transactions, reconcile accounts, send invoices and estimates, track mileage and receipts, and run financial and 1099 reports. We may add, change, or remove features over time.

3. Not Tax, Legal, or Accounting Advice

The Service — including reports, 1099 summaries, auto-categorization, and answers from Penny, our AI assistant — is provided for informational purposes only and is not tax, legal, or accounting advice. AI-generated answers and suggestions can be wrong; review them before relying on them. Consult your CPA or another qualified professional before filing taxes or making financial decisions.

4. Your Account & Users

You must provide accurate information and keep your login secure. You are responsible for all activity under your account, including the actions of users you invite to your companies and the roles you give them. Tell us right away at mc@bigez.com if you suspect unauthorized access.

5. Your Data

You own the financial data you enter or import. You give us permission to store, process, and transmit it only as needed to provide the Service, as described in our Privacy Policy. You are responsible for the accuracy of your data and for keeping your own copies; you can export your company data at any time.

6. Subscriptions, Payments & Refunds

Paid plans are billed in advance on a monthly or annual basis through our payment processors (Stripe or ThriveCart) and renew automatically until cancelled. Penny AI credits and optional services such as onboarding or bookkeeper support are one-time purchases. You can cancel anytime; cancellation stops future renewals, and you keep access through the end of the paid period. Refunds are handled under our Refund Policy at bigez.com/refund-policy. We may change prices with advance notice before your next renewal.

7. Acceptable Use

You agree not to misuse the Service, including by: breaking any law; entering data you do not have the right to use; attempting to access other customers’ data; interfering with or overloading the Service; reverse-engineering it; or using it to send spam or unlawful messages.

8. Third-Party Services

Some features rely on third parties, including Stripe and ThriveCart for payments, OpenAI for Penny and receipt scanning, Resend and Google for email delivery, and Nutshell for demo follow-up. Their own terms and policies may also apply, and we are not responsible for services we do not control.

9. Text Messages

If you opt in to text messages, Big E-Z Bookkeeping Co. may text you about your demo and our offers. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help, or contact mc@bigez.com. Carriers are not liable for delayed or undelivered messages. Consent to receive texts is not a condition of any purchase. See our Privacy Policy for how we handle mobile numbers.

10. Availability & Disclaimer

We work to keep the Service available and accurate, but it is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, Big E-Z Bookkeeping Co. is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or penalties, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim.

12. Termination

You may stop using the Service and cancel at any time. We may suspend or end access for accounts that violate these Terms or fail to pay. When a company is deleted, it enters a 14-day grace period before removal, as described in our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will change the effective date above and notify you of significant changes by email or in the Service. Continuing to use the Service after changes take effect means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the state courts located in Oakland County, Michigan, or the federal courts for the Eastern District of Michigan, and you consent to the jurisdiction of those courts.

15. Accessibility

Big E-Z Bookkeeping Co. is committed to providing equal access to our website and the Service for everyone, including people with disabilities. We are continually working to improve accessibility. If you encounter a barrier while creating, managing, retrieving, or exporting your business accounting records, or using any other part of the Service, email mc@bigez.com and tell us what you were trying to do. We will work with you to provide the information or help you need through an alternative method, such as assisted data entry, exporting your records for you, or providing reports in another format, at no additional charge.
